The Association for Communication and Advertising (ACA) provides the ACA website subject to the user’s compliance with the terms and conditions stated below. Please read this before accessing the ACA site. By accessing this site, you agree to be bound by the terms and conditions below. If you do not wish to be bound by these terms and conditions, you may not access or use the ACA site.

1. Rules

While visiting the ACA site, you may not:

Post, transmit or otherwise distribute information constituting or encouraging conduct that would constitute a criminal offence or give rise to civil liability, or otherwise use the site in a manner which is contrary to law or would serve to restrict or inhibit any other user from using or enjoying the site or the Internet.
Post or transmit any information or software, which contains a virus, Trojan horse, worm or other harmful or disruptive component.
Upload, post, publish, transmit, reproduce, or distribute in any way, information, software or other material obtained through the site which is protected by copyright, or other intellectual property right, or derivative works with respect hereto, without obtaining permission of the copyright owner or right holder.

2. Monitoring

The ACA has no obligation to monitor the site. However, you agree that ACA has the right to monitor the site electronically from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate the site properly, or to protect itself or its subscribers. The ACA will not intentionally monitor or disclose any private electronic-mail message unless required by law. It reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this agreement.

3. Privacy

The ACA cannot ensure or guarantee privacy for users of the site. It is therefore recommended that this service not be used for the transmission of confidential information. Any such use shall be at the sole risk of the user, the ACA and its affiliates, suppliers and related companies shall be relieved of all liability in connection therewith.

4. Buying over the Internet

When making purchases or conducting other transactions through the site or the Internet, you may be asked by the Merchant or Information or Service Provider, to supply certain information, including credit card or other payment mechanisms. You agree that all information you provide any Merchant or Information or Service Provider through the site will be accurate and complete. You agree to pay all charges incurred by you or other users of your account or credit card or other payment mechanisms at the prices in effect when such charges are incurred. You also will be responsible for paying all applicable taxes, if any, relating to purchases on the site. The ACA is in no way responsible for any charges you or any user of your account incurs when making purchases or other transactions in this manner.

5. Limitation of Liability

The Association for Communication and Advertising takes no responsibility for the accuracy or validity of any claims or statements contained in the documents and related graphics on the site. Further, the ACA makes no representations about the suitability of any of the information contained in documents and related graphics on the site for any purpose. All such documents and related graphics are provided without warranty of any kind. In no event shall the ACA or its suppliers or affiliates be liable for any damages whatsoever, including special, indirect or consequential damages, arising out of or in connection with the use of information available on the site.

6. Recourse

If you are dissatisfied with the site or with any terms, conditions, rules, policies, guidelines, or practices of the ACA in operating the site, your sole and exclusive remedy is to discontinue using the site.

7. Confidential Information

You authorise the ACA to collect from any party and to retain all relevant information relating to your use of the site, and you hereby authorise any party to provide us with such information.

8. Indemnity

You agree to defend, indemnify and hold the ACA and its affiliates, suppliers and related companies harmless from any and all liabilities, costs and expenses, including reasonable attorneys’ fees, related to any violation of this Agreement by you or users of your account, or in connection with the use of the site or the Internet or the placement or transmission of any message, information, software or other materials on the site or on the Internet by you or users of your account.

9. Trademarks

The Association for Communication and Advertising, and other trademarks, logos and icons identifying the ACA and its products and services referenced herein are trademarks or registered trademarks of the ACA. All other product and/or brand or company names mentioned herein are the trademarks of their respective owners.

10. Miscellaneous

This Agreement, including any and all documents referenced herein, constitute the entire agreement between the ACA and the user pertaining to the subject matter hereof. The ACA’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provisions or right. If any of the provisions contained in this Agreement were determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein. This Agreement shall be governed by and construed in accordance with the prevailing laws of South Africa.

11. Detailed description of goods and/or services

The ACA is a business in the advertising and communications industry.

12. Delivery policy

Subject to availability and receipt of payment, requests will be processed within 1-5 days and delivery confirmed by way of an emailed confirmation. Where a physical product is purchased, the ACA does not fulfill deliveries; rather the purchaser is required to collect the item/s from the ACA offices, at ACA House, The Braes Office Park, cnr. William Nicol and Bryanston Drive Bryanston Johannesburg.

13. Return and Refunds policy

The provision of goods and services by the ACA is subject to availability. In cases of unavailability, the ACA will refund the client in full within 30 days. Cancellation of orders by the client will attract a 15 % administration fee. No warranties or guarantees are offered on any item sold through this web site.

14. Customer Privacy policy

The ACA shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). 15. Payment options accepted

Payment may be made via Visa, MasterCard, PayPall or EFT.

16. Card acquiring and security

Card transactions will be acquired for the ACA via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

17. Customer details separate from card details

Customer details will be stored by the ACA separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.

18. Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

19. Responsibility

The ACA takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

20. Country of domicile

This website is governed by the laws of South Africa, and the ACA chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, ACA House, The Braes Office Park cnr William Nicol and Bryanston Drive Bryanston Johannesburg.

21. Variation

The ACA may, in its sole discretion, change this agreement or any part thereof at any time without notice.

22. Company information

This website is run by The Association for Communication and Advertising (ACA) (NPC) based in South Africa trading as ACA and with registration number 1971/008178/09 and a board of Directors.
